Occupational Noise Exposure - Conservation and Audiometric Testing

OSHA Reference: General Industry 29 CFR 1910.95 (g) (6) "Annual audiogram." At least annually after obtaining the baseline audiogram, the employer shall obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels. IF this remains, maybe only request a Letter from the Audiometric Testing Facility verifying this. Otherwise, this could be private/HIPPA related. (l) Access to Information and Training Materials (1) The employer shall make available to affected employees or their representatives copies of this standard and shall also post a copy in the workplace. (2) The employer shall provide to affected employees any informational materials pertaining to the standard that are supplied to the employer by the Assistant Secretary. (3) The employer shall provide, upon request, all materials related to the employer’s training and education program pertaining to this standard to the Assistant Secretary and the Director.

This training is recommended Annually or when any changes occur to the Hot Work Permit system and/or hot work activities. The following OSHA regulations are applicable to construction hot work: 1926 Subpart J - Welding and Cutting; 1926.350 - Gas Welding and Cutting; 1926.351 - Arc Welding and Cutting; 1926.352 - Fire Prevention; 1926.353 - Ventilation and Protection in Welding, Cutting, and Heating; 1926.354 - Welding, Cutting, and Heating in Way of Preservative Coatings.

MSHA Part 46 Miner

Per the United States Department of Labor MSHA website:

46.2 The definition of miner includes any construction worker who is exposed to hazards of mining operations.

(b)(5) The record must include a statement signed by the person designated in the MSHA-approved training plan for the mine as responsible for health and safety training, that states ‘‘I certify that the above training has been completed.”

(h) You must maintain copies of training certificates and training records for each currently employed miner during his or her employment, except records and certificates of annual refresher training under § 46.8, which you must maintain for only two years. You must maintain copies of training certificates and training records for at least 60 calendar days after a miner terminates employment.

Please upload the following information:

1. A completed copy of the MSHA 5000-23 Form; and / or

2. A document consisting of the following required fields:

a. The printed full name of the person trained

b. The type of training (e.g. new miner, experienced miner, or annual refresher), duration of training, date the training was recieved, and the name of the competent person who provided the training.

c. The name of the independent contractor with their identification number and the location of the training.

d. The statement "False certification is punishable under Sec. 110(a) and (f) of the Federal Min Safety and Health Act," printed in a conspicuous manner.

e. Signature of the trainer.
